Typically a lawyer does not get involved in the real estate deal until after the contract is signed. This means that any questions or problems with the purchase and sale contract should go to the person responsible for drafting the agreement, your real estate agent.

It is the job of the lawyer for the vendor to arrange for the vendor to sign the transfer documents and to payout any mortgage the vendor has on title. It is the job of the purchaser's lawyer to create the paperwork for the transfer, arrange for registration at the Land Title Office and arrange for payment of the purchase price. If the purchaser requires a mortgage to finance their purchase, their lawyer will often act for the bank and create these documents as well.

To Do:

  1. Fill out the Real Estate Purchaser Questionnaire or Real Estate Vendor Questionnaire.
  2. You will need to make sure your real estate agent and banker get documents to us as early as possible so that we can arrange for the searches and drafting of transfer documents.
  3. Once we have all the documents prepared, we will meet to have you sign and then take care of the filing and transfers on the completion date of your purchase.
