Who Needs This Service?

  • You are named the administrator/executor of someone's estate.
  • A family member dies intestate (without a will) and you feel you are the appropriate person in the family to act as the representative for their estate.

In order to deal with the estate you will need to make numerous applications in order to get the legal right to do the various tasks expected of you. You will have to gain access to bank accounts, transfer or sell properties, make funeral arrangements, pay debts and taxes, etc. In many situations, the executor/executrix will hire a lawyer to help them prepare the necessary documentation and make the applications.

Did you Know?

  • Even if you are named as executor/executrix you can decline to act. You may decide that the grief is too much for you to deal with the issues. Alternately, you may feel there is a conflict if you are one of the beneficiaries.
  • To file for probate/administration it will not cost the estate anything in fees for the first $25,000.00 of the estate, but will cost $6 per $1,000.00 above that, with a total of no more than $50,000.00 in probate fees. For estates over $50,000.00 the fee is $14 per $1,000.00.
